The employer-employee relationship (E-ER) is in many ways akin to that of a husband and a wife; colloquially, employment is a sort of ‘wedding’contract between the employer and the employee.2 An employee is “a person who works in the service of another person (the employer) under an express or implied contract of hire, under which the employer has the right to control the details of work performance.”3 The essence and implications of the ‘nuptial knot’ tied via an employment contract is a key underpinning of employment, industrial and labour law.
